Business and Service Rules (Terms and Conditions)

General Rules

Our delivery will be according to our terms and conditions. All prices are declared in EURO, including VAT and (if delivery is requested) plus shipping costs. All prices are without liability. The delivered goods remain our property until full payment. The privities of contract are exclusively subjected to the laws of Germany. Details on weight, geometries and equipment are from the manufacturer. Technical changes for purposes of a technical advancement as well as deviation in colour, errors and printing mistakes are reserved.

Delivery Service

If our delivery service is used, the delivery will be exercised from our store to the delivery address stated by the costumer - if not agreed upon otherwise. The risk passes to the costumer as soon as the delivery has left our premises. All our deliveries have extensive transport insurance. Delivery will be made as long as stock lasts.

The shipping costs for a delivery depend on the value of the goods of the whole delivery and the size of the goods and are stated bindingly with the confirmation of the order and the transmission of the terms of payment. We reserve not to deliver at all or to deliver equivalent items. If not specifically agreed upon differently, partial shipments are, depending on the delivery situation, at our own discretion.

Damage during Shipment

Please notify us of evident defects within 8 days. Please keep in mind that in case of damaged goods a notification of claim must be made by the post or the delivery service respectively. Should a parcel reach you in a visibly damaged state, open it in the presence of the postman/parcel service and ask them to issue a notification of claim immediately. This also applies for damage that is noticed after unpacking or usage despite an undamaged packing. Important: Do not send deliveries that have been evidently damaged during transport back to us without a written notification of claim or any other verification of complaint of damage. In case of non-compliance with these guidelines the customer bears the risk that the enforcements of the damage with the transportation company or the insurance company respectively is unsuccessful. Terms of Payment

Orders of more than 400 Euro only cash before delivery.

Orders of less than 400 Euro also pay on delivery.

Warranty

The warranty on the products is 24 months and starts with the date of delivery.

Evident defects must be reported to us instantaneously and in writing within 2 weeks after reception of the goods, at the latest.

The costs of rework or replacement deliveries are borne by us. Should rework or a replacement delivery be impossible for us, or are these delayed for longer than the appropriate time limit for reasons we are responsible for, or does rework or replacement delivery fail in any other way, the customer can ask for the annulment of the contract or a reduction of the contract price. Any further compensation is not possible at any rate. Warranty claims expire when the buyer does not abide the rules concerning usage and treatment (i.e. care, maintenance) of the product.

Such regulations can be found in operating and maintenance manuals, which are enclosed to the product. Warranty claims expire with natural wear and tear.

Further claims by the ordering person are not possible.

The bill of purchase counts as the document of warranty. The period of warranty is not extended by warranty services – this is also true for replaced or repaired parts. A warranty service free of charge requires the presentation of a copy of the bill of purchase. The buyer is obliged to permit us the check of the faulty items. Should the buyer refuse us to check the items, we are released from the obligation of warranty services.

Sale or Return

We want you to be satisfied with our goods. Therefore, you can return your purchases to us within 14 days. This period starts with receipt of the goods and this instruction. This return service applies to all deliveries except for productions that were made individually. Beside this 14-day return service you are of course entitled to your legally guaranteed warranty claims.

Consequences of Return

Should a return come into effect, the contract of purchase/hire-purchase becomes invalid. In case of prior use or deterioration of the item we are entitled to ask for compensation of value. This does not count for deterioration of items that can be exclusively put down to checks which could have been carried out in the bike-store. You can avoid compensation of value by not using the item like the owner of it and by avoiding everything that could reduce its value.

Information on Data Protection

We process personal data for the order transaction. All personal data will be treated strictly confidentially, of course. We save your data insofar as they are necessary for business and in accordance with the German Data Protection Law (Bundesdatenschutzgesetz) (§ 28 BDSG).

Partners of Contract, Final Clauses

We assume no liability for the contents of external homepages which are referred to from our homepage using a link and explicitly declare that we have no influence on the construction and contents of external homepages.

The place of performance for all deliveries and services is Dresden, Germany. The exclusive area of jurisdiction is Dresden. The laws of the Federal Republic of Germany are binding.

Any notices and announcements that are rendered towards us must be in writing for validity reasons. Should one or more clauses of these terms and conditions be partly or fully invalid or lose its legal validity at a later stage the validity of the other clauses of these terms and conditions remains unaffected.

In case of differences between the German and the English version of these terms and conditions or translation mistakes, the German version is legally binding.
